Terms and conditions

Welcome to Maison C&R (“we”, “us”, “our”).

These Terms & Conditions (“Terms”) govern your access to and use of our website and the purchase of products from our online store.

By browsing our website, placing an order, or purchasing any product, you agree to be bound by these Terms and the policies incorporated by reference, including our Returns & Repairs Policy, Warranty Policy, and Privacy Policy (together, the “Policies”).

If you do not agree to these Terms, you must not use our website or purchase our products.

USE OF WEBSITE

You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order.

You agree not to:

  • use the website for unlawful purposes

  • interfere with the website’s operation or security

  • copy, scrape, or commercially exploit any content

  • provide false, misleading, or unauthorised payment or identity information

We reserve the right to suspend or refuse access to the website where these Terms are breached.

PRODUCTS & CRAFTSMANSHIP

Maison C&R pieces are crafted using precious metals, natural gemstones, and lab-grown diamonds.

You acknowledge that:

  • natural gemstones vary in colour, tone, clarity and character

  • lab-grown diamonds, while optically and chemically identical to mined diamonds, may exhibit subtle variations in appearance

  • handcrafted jewellery may exhibit slight variations due to artisanal production processes

  • precious metals may develop patina or surface marks over time with normal wear

  • product images are indicative only and may appear different depending on screen settings

These characteristics are inherent to fine jewellery and are not considered faults.

MADE-TO-ORDER & PRODUCTION TIMEFRAMES

Many Maison C&R pieces are made to order.

Production and dispatch timeframes shown on the website are estimates only and commence from the first business day after order confirmation. Delays may occur due to craftsmanship processes, material availability, or circumstances beyond our reasonable control.

If you require a piece by a specific date, you must contact us prior to ordering.

ORDERS & ACCEPTANCE

Placing an order constitutes an offer to purchase.

An order is not accepted until we confirm dispatch or collection. Order confirmation emails acknowledge receipt only and do not constitute acceptance.

We reserve the right to cancel or refuse an order at any time prior to dispatch, including where:

  • payment cannot be verified

  • pricing or product errors occur

  • products are unavailable

  • we reasonably suspect fraud or misuse

If an order is cancelled, any payment received will be refunded in full.

PRICING & PAYMENT

All prices are listed in AUD and include GST where applicable.

Payment must be made in full at checkout using the payment methods available on our website, including third-party providers such as Shopify Payments, PayPal, Afterpay, or others listed.

Payment information is processed securely by our third-party payment providers. Maison C&R does not store or have access to full credit card details.

For international orders, duties, taxes or customs charges may apply and are the responsibility of the recipient.

PROMOTIONS & OFFERS

Promotions, giveaways, welcome offers and sales are subject to specific promotional terms disclosed at the time of the offer.

Unless stated otherwise:

  • offers cannot be applied retrospectively

  • offers cannot be combined

  • complimentary items are not redeemable for cash or exchange

  • Maison C&R reserves the right to amend or withdraw promotions at any time

SHIPPING & DELIVERY

We ship using trusted carriers with tracking and, where applicable, insurance.

Delivery timeframes are estimates only and do not include production time.

Risk in the products passes to you upon delivery to the address provided. Title passes once full payment is received.

If a parcel is lost or damaged in transit, please contact us promptly and we will assist with the carrier claim process.

RETURNS

Maison C&R offers change-of-mind returns strictly in accordance with our Returns & Repairs Policy.

Change-of-mind returns are accepted within 14 days from the date of delivery, subject to eligibility criteria and exclusions set out in that policy.

Approved change-of-mind returns are issued as Maison C&R store credit only. Refunds to the original payment method are not offered for change-of-mind returns. Original shipping fees are non-refundable.

Nothing in these Terms limits or excludes your rights under the Australian Consumer Law.

WARRANTY

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).

In addition, Maison C&R offers a 12-month manufacturing warranty from the date of purchase covering defects in materials or workmanship, as set out in our Warranty Policy.

Where a valid warranty claim is accepted, the piece will be repaired or replaced as appropriate, in accordance with Australian Consumer Law.

Warranty exclusions, claim assessment processes, paid repairs, and post-repair coverage are governed by the Warranty Policy, which forms part of these Terms.

CARE & RESPONSIBILITY

Fine jewellery requires appropriate care.

You are responsible for following our Care Guide. Damage resulting from improper care, misuse, impact, or failure to follow care instructions is not considered a manufacturing fault.

REPAIRS

Repairs, resizing and maintenance are assessed on a case-by-case basis.

Repair eligibility, shipping responsibilities, fees and workmanship coverage are governed by our Returns & Repairs Policy and Warranty Policy.

You must contact us and receive return instructions before sending any item for repair.

INTELLECTUAL PROPERTY

All content on the website, including designs, images, text, logos and branding, is owned by Maison C&R and protected by intellectual property laws.

You may not reproduce, distribute or use our content for commercial purposes without written consent.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, our liability arising from or in connection with these Terms or the supply of products is limited to the price paid for the relevant product.

We are not liable for indirect or consequential losses, loss of profit, or loss of opportunity.

Nothing in this clause limits or excludes rights under Australian Consumer Law.

FORCE MAJEURE

We are not liable for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, supply chain disruptions, government actions or carrier delays.

PRIVACY

Personal information is handled in accordance with our Privacy Policy and the Australian Privacy Principles.

INCORPORATED POLICIES

These Terms incorporate and should be read together with our Returns & Repairs Policy, Warranty Policy, and Privacy Policy, each of which forms part of this agreement.

In the event of any inconsistency, the Australian Consumer Law prevails.

CHANGES TO TERMS

We may update these Terms from time to time. The version applicable to your purchase is the version in effect at the time you place your order, as indicated by the “Last updated” date below.

GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia.
You submit to the exclusive jurisdiction of the courts of New South Wales.
